Case of the ICICI Bank loan scam Chanda Kochhar receives no relief

The Kochhar couple and the other suspects have been ordered by the special court to attend the charge-fixing procedure. On the 22nd of the next month, the special court would begin the process of formulating charges.


The former CEO of the bank, Chanda Kochhar, has filed a petition in the High Court against the approval granted by the ICICI Bank board of directors for criminal proceedings. It has also been requested that the petition be heard as soon as possible. On Monday, however, the court rejected their request.


CBI cases are seldom the first to be filed. Years pass before it begins. Thus, a bench consisting of Justices Revathi Mohite-Dere and Shyam Chandak narrowly declared that Kochhar's fear of action was unfounded, postponing the hearing of his request for a period of three weeks.


The Kochhar couple and the other suspects have been ordered by the special court to attend the charge-fixing procedure. On the 22nd of the next month, the special court would begin the process of formulating charges. After hearing all sides and evaluating the evidence, the trial court states its preliminary belief that the accused are guilty of the offense during the framing of charges procedure. The trial has also started. In light of this, Kochhar's attorneys requested an expedited hearing for the plea. However, Additional Advocate General Devang Vyas, speaking for the federal government, informed the court that the plea did not need an immediate hearing since the question of sanction to action may be brought up at any point during the trial.


Nonetheless, the court has to give precedence to considering the outstanding petitions over the last ten years. The court made it clear that Kochhar's request could not be considered immediately. The court also ordered Kochhar to notify the trial court of the status of the petition and to request an extension of time to begin the process of framing charges.
