 The SC rejects the argument against the Gyanvapi case being moved from one HC court to another


The appeal contesting the maintainability of a suit seeking the restoration of a temple at the location of the Gyanvapi mosque in Varanasi was being heard by the single-judge court.


The Anjuman Intezamia Masjid Committee's appeal against the chief justice's administrative order of the Allahabad High Court to remove the Gyanvapi case from a single-judge bench that has been hearing it since 2021 was rejected by the Supreme Court on Friday.


The appeal contesting the maintainability of a suit seeking the restoration of a temple at the location of the Gyanvapi mosque in Varanasi was being heard by the single-judge court.


Judges J B Pardiwala, Manoj Misra, and Chief Justice D Y Chandrachud dismissed the case after hearing arguments from veteran counsel Huzefa Ahmadi, who was speaking on behalf of the mosque committee.


We must respect the high court's top justice's directive and refrain from interfering.It is a fairly common practice in high courts. The bench concluded that this must fall within the purview of the high court's chief justice.


The Anjuman Intezamia Masjid Committee (AIMC) is contesting the high court chief justice's decision to transfer the case from a single judge bench to another bench. The CJI examined the grounds for the case's transfer before rejecting the petition, stating he did not wish to read them in public.


The Allahabad High Court postponed the hearing on the AIMC's plea until November 8 on October 30. The Archaeological study of India claimed to have "completed" the study of the Gyanvapi mosque complex, but required additional time to produce a report. On November 2, a Varanasi court granted the ASI an extension until November 17.


By November 6, the ASI was expected to turn in the survey report.
