Supreme Court to hear Google's plea against CCI fine on January 16

 


• Google - CCI case: NCLAT directs Google to deposit 10% of the penalty amount within three weeks


The Supreme Court on Wednesday agreed to hear Google's appeal against a National Company Law Appellate Tribunal (NCLAT) judgment which refused to stay a penalty of ₹1,337.76 crore imposed on it by the Competition Commission of India (CCI). Had done it. Alleged Anti-Competitive Practices.


Earlier last week, the NCLAT refused to stay the order passed by the Competition Commission of India (CCI) after observing that the order was passed on October 20, 2022, but the appeal against it would be on December 20, 2022. was filed.


The NCLAT had also directed Google to deposit 10 per cent of the penalty amount within three weeks.


"Be that as it may, once the order was passed in the month of October, if there was any such urgency it was expected that the appellant would have immediately approached this Tribunal. However, in this case no such urgency could be found in the filing appeal and thus the appellant cannot be permitted to press for an interim order, that too when we are granting a shorter date for the final hearing of the appeal."


On October 20 last year, the CCI imposed a fine of ₹1,337.76 crore on Google for anti-competitive practices with respect to Android mobile devices. In the October verdict, the CCI had also ordered the internet major to cease and desist various unfair business practices.


This was challenged by Google before the NCLAT, which is an appellate authority on the CCI, against any directions issued by the regulator.


However, the National Company Law Appellate Tribunal (NCLAT) denied any immediate relief and said: "We are of the opinion that at the moment, in view of the voluminous nature of the appeal and the fact that the date of final hearing has been fixed for April 3, No interim order is required to be passed till 2023."
