Mumbai Police makes seat belt mandatory for driver and co-passengers

• On 14 October, Mumbai Police had issued a notification saying that from 1 November 2022 it will be mandatory for the driver and co-passengers to wear seat belts.

In its notification, the Mumbai Police had said that anyone who drives a motor vehicle without wearing a safety belt or does not wear a seat belt to passengers will be punishable.

The Mumbai Police had also said that a motor vehicle that does not have a seat belt facility will have to wear seat belts for all passengers, as reported by ANI. The due date for this was also fixed as November 1, 2022.

"All motor vehicle drivers and all passengers in vehicles who travel on Mumbai city roads are hereby informed that it will be mandatory for drivers and all passengers to wear seat belts while traveling with effect from 01/11/2022. Otherwise, action will be taken under section 194(b)(1) of the Motor Vehicles (Amendment) Act 2019," read the notification.

A traffic police official told news agency PTI that since the imposition of seat belts in cars in Mumbai, the focus of the police will be to sensitize four-wheeler drivers and co-passengers.

"While taking action against motorists and co-travellers, our focus will be on sensitizing drivers and co-passengers who do not wear seat belts," he said.

Traffic police have been directed to take action against drivers not wearing seat belts, but we will issue warnings to four wheelers who do not have rear seat belts.

He said the police would ask the owners of such cars to put on rear seat belts.

The seat belt mandate comes after the death of renowned industrialist and former Tata Sons chairman Cyrus Mistry in a road accident. Soon after the accident, there were reports of him not wearing the rare seat belt. According to Palghar police, Mistry was going from Ahmedabad to Mumbai when his car collided with the divider. There were four people in the car. Two including Mistry died on the spot, while the other two were admitted to the hospital.

Following this incident, the Union Ministry of Road, Transport and Highways issued a draft rule making it mandatory for car manufacturers to install seat belt alarms on all seats of cars. Earlier in September, Union Minister Nitin Gadkari had said that from now on it will be mandatory for all passengers in a car to wear seat belts, including those in the rear seats, and that violating the rule will be fined.

He also pointed out that the security alarms that usually beep when seat belts are not worn in the front seats will now be done the same for rare seat passengers. The Union Minister clarified that the new rule will be applicable to all types of cars, small and big.

Union Minister Nitin Gadkari tweeted, "Now it will be mandatory for everyone in the car to wear a seat belt." He had also highlighted that there would be safety beeps for rare seats along with the front seats that would resonate if seatbelts were not worn.

Before Mumbai, in September, to intensify road safety rules, the Delhi Traffic Police had also launched a special drive to encourage people to use rear seat belts, failing which they would be charged ₹1,000. will have to pay the fine.
