According to Bloomberg, the US Supreme Court on Wednesday inadvertently posted a draft ruling on a significant abortion issue on its internet before quickly taking it off. The ruling addresses whether hospitals in Idaho are required to provide emergency abortions even if the operation is illegal under state law.
Bloomberg News claims that the opinion was removed from the internet on Wednesday after it was only available for a short while.
The court's spokeswoman, Patricia McCabe, said Fox News that the opinion has not yet been made public. "A document was momentarily and unintentionally put on the Court's website by the Publications Unit of the Court. In due order, the Court will release its rulings in Moyle v. United States and Idaho v. United States, she said.
According to Bloomberg, the opinion's briefly uploaded form suggested that the court would probably decide in the federal government's favor. If this is the case, hospitals in places where abortion is illegal will have to conduct abortions on patients in an emergency while the lawsuit is still pending.
The ruling, which was uploaded, said that because lower courts had not yet reached a decision in this issue, it was premature to determine the case on its merits and that the case ought to be sent back to a federal court of appeals.
Following the overturning of Roe v Wade in June 2022, Idaho passed one of the strictest anti-abortion laws in the country.
It forbids the practice "when necessary to prevent the death of the pregnant woman," only permits it in rape and incest instances, and penalizes doctors who perform abortions with up to five years in prison.
