Currently, the spouse of a deceased government employee receives the family pension first. Women workers who have strained relationships with their spouses may find some respite from this new regulation.

Seventh Pay Commission: The federal government announced a significant modification to the pension regulations on the second day of the new year. In the event of marital disagreement, a woman government employee or retiree may now designate her children for family pension before her spouse, according to a Tuesday announcement from the Ministry of Personnel, Public Grievances and Pensions. Currently, the spouse of a deceased government employee receives the family pension first. The government's new regulation will help women workers who have strained relationships with their spouses. These ladies will be able to provide for their kids' futures.

What the current regulations are:

In accordance with sub-rules (8) and (9) of Rule 50 of the CCS (Pension) Rules, 2021, the surviving spouse of a dead government employee or pensioner shall get the family pension first. The children and other family members won't be able to get the family pension until after this. This is only relevant in cases when the dead person's spouse either passes away or is not entitled for a family pension.

In what situation 

It has been determined that if a government employee or pensioner is divorcing her spouse or if the employee or pensioner has filed a domestic abuse complaint against her spouse, the divorce will continue. When it comes to receiving her family pension after death, a government employee or pensioner who is a woman may choose to prioritize her qualified kid or children above her spouse. There are, nonetheless, additional requirements for this.

In cases when a dead woman government employee or retiree has a spouse who is still alive and whose children meet the eligibility requirements, the children will receive a family pension. In addition, family pension will be paid to the widower if there is a widower (i.e., spouse) in the family of the dead government employee or female pensioner and no kid is entitled for family pension on the date of the female employee's death.

when the widower and any minor children or youngsters with a mental illness or handicap make up the dead government worker's or female pensioner's household. If the spouse is the guardian of the kid or children in question, he is entitled to the family pension in this situation.

In the event that the widower no longer serves as the kid's guardian, the child will receive the family pension from the person serving as the child's legal guardian. When a minor kid reaches majority and becomes eligible for a family pension, that child's pension will begin to be paid on the day the child reaches majority.
