Case of Gyanvapi: Allahabad High Court dismisses appeal by mosque committee

Judge Rohit Ranjan Aggarwal delivered the decision, ruling that the 1991 lawsuit brought before the Varanasi court may be maintained and was not in violation of the 1991 Places of Religious Worship Act.

All five lawsuits contesting the maintainability of a civil complaint seeking the restoration of a temple at the location of the Gyanvapi Mosque that was pending before a Varanasi court were rejected by the Allahabad High Court on Tuesday.

Judge Rohit Ranjan Aggarwal delivered the decision, ruling that the 1991 lawsuit brought before the Varanasi court may be maintained and was not in violation of the 1991 Places of Religious Worship Act.

A thorough investigation of the Gyanvapi mosque site was ordered by the court.

The Anjuman Antejamia Masjid Committee (AIMC) and the Uttar Pradesh Sunni Central Waqf Board both opposed the Varanasi court's April 8, 2021 decision to undertake a thorough study of the Gyanvapi Masjid in their applications.

The AIMC, which oversees the operation of the Gyanvapi Mosque, which is next to the Kashi Vishwanath temple in Varanasi, has contested the maintainability of a lawsuit that Hindu petitioners filed in the Varanasi court, requesting the reconstruction of a temple at the location. where Gyanvapi is located. There is a mosque there right now.

The Hindu petitioner claims that Gyanvapi Mosque is a component of the temple.

The main contention of the Anjuman Intejamia Masajid Committee and the UP Sunni Central Waqf Board was that the Places of Worship (Special Provisions) Act 1991, which forbids altering the nature of religious sites that were already in existence on August 15, 1947, precluded the suit.
