 AAP's Raghav Chadha challenges a Patiala court judgment in a Delhi home allocation dispute by moving to the Delhi High Court


Raghav Chadha, an AAP member of parliament, appealed a lower court decision that had invalidated an interim order prohibiting the Rajya Sabha secretariat from evicting him from the government home he was assigned on Tuesday to the Delhi High Court.


According to PTI, a bench consisting of Chief Justice Satish Chandra Sharma and Justice Sanjeev Narula approved the request for an accelerated hearing of the plea and added it to the court's schedule for Wednesday.




The Member of Parliament had received an eviction notice, according to Chadha's legal counsel, and the eviction procedure is currently underway. She mentioned that the trial court had previously imposed a stay order, but it has since been lifted.


The trial court noted in a judgment dated October 5 that Chadha cannot assert an unambiguous entitlement to remain in the government house for the duration of his term as a Rajya Sabha MP, even after his allotment was cancelled.


When the trial court overturned an interim order issued on April 18 instructing the Rajya Sabha Secretariat not to evict Chadha from the government mansion, the trial judge made the statement mentioned above.


The court emphasized that Chadha had been given interim relief with the understanding that he wouldn't be kicked out of the apartment without the correct legal steps being taken.
