CM Himanta Biswa Sarma requested advice

The public is encouraged to submit recommendations through email or postal mail until August 30 according to the notification released by the Principal Secretary, Home and Political Department. The announcement said that a special committee had been established by the state government to study potential laws outlawing polygamy.


State has the authority to enact laws:

The study made the point that the state government has the authority to pass legislation outlawing the marital custom. Marriage is under the Concurrent List, according to the public notice, allowing both the Centre and the states to make laws on it.


The notification stated that the court has made it plain that in order to qualify for protection, religious practises must be fundamental and intrinsic to the religion in question. The rule restricting the number of spouses falls within the category of social welfare and reform and does not interfere with the freedom to practise one's faith. Laws that support monogamy thus do not contravene Article 25. The State of Assam shall have the legislative authority to establish a State Legislature to outlaw polygamy while keeping these principles in mind.


On August 6, the committee turned in its report

On August 6, the Assam government's expert committee delivered its recommendation to the chief minister about the outlawing of polygamy. The CM then declared that this fiscal year will see the introduction of a law on the matter. According to the CM, the committee unanimously decided that the state should be able to create its own legislation to outlaw polygamy.
