Construction regulations near highways: It could be challenging for you to build a home close to a highway. The government has the right to demolish a house and withhold compensation if it is not outside of a specific radius.

The Uttar Pradesh Road Control Act of 1964 makes it very clear that on National Highways or State Highways, 60 feet must be left from the centre line of the road, while 50 feet must be left on Ordinary District Roads. Any open construction, border work, etc., can only be done after leaving this space.

The regulations state that no construction is permitted on either side of the highway within 75-75 metres of the centre. If the construction is crucial, approval from the NHAI and Ministry of Highways must be obtained. 


The new system clearly complies with Section 42 of the National Highway Control Act, which states that no permission will be granted for construction up to 40 metres from the middle of the highway. However, if the landowner wishes to carry out any significant work within the radius of 40 to 75 metres, they must first obtain permission from the NHAI. You must have authorization. The Ministry of Highways will give the No Objection Certificate (NOC) on the advice of NHAI. The map won't be passed unless it has received the NOC from the Ministry of Highways, the relevant Development Authority, or the District Panchayat.
